Please read the following waivers carefully for both Ballard Health Club and City of Seattle and accept the terms at the bottom. This submission is only required once.

BALLARD HEALTH CLUB

  1. I am aware that I will engage in physical exercise at Ballard Health Club, including, but not limited to, the use of exercise machines, free weights, and club fitness training and instruction, which could cause injury to me. I am voluntarily participating in these activities and assume all risk including negligence caused by me. I hereby voluntarily and forever release, discharge, waive, and relinquish any and all actions, causes of action, or claims for personal injury, property damage, or wrongful death occurring to me arising out of my use of the facilities against Ballard Health Club, its agents, and employees.

  2. I understand that Ballard Health Club will make no medical diagnosis as to whether I am sufficiently fit for any exercise activities. If I know or suspect that I am not in good physical condition, especially concerning any previous or present illness or injury that may affect my participation in strenuous exercise, I understand that it is my responsibility to consult with my physician. Therefore, I agree to be solely responsible for all expenses and damages incurred because of any injury sustained, medical event, illness, or other physical condition arising out of or related to my use of Ballard Health Club’s facilities, equipment, services, or participation in any activities on the premises.

  3. Members are expected to attire and equip themselves properly for safe use of club facilities. This includes wearing proper footwear while exercising or walking on damp or wet floors in the shower or sauna areas and related precautionary measures.

  4. Ballard Health Club reserves the right to change any rule or regulation at any time for the orderly, efficient, and safe operation of the business or for any other purpose deemed appropriate by Ballard Health Club.

Absolute Release of Liability Against City of Seattle

The Participant fully understands that participation in this activity includes the risk of personal injury. In consideration of being permitted to participate in the activities of Ballard Health Club in any manner, including but not limited to tours or classes, the Participant (individually and on behalf of his or her family, heirs, successors and assigns) fully and absolutely assumes all responsibility for the risk of injury and/or other harm due to participation, weather conditions, park conditions (including but not limited to the condition of the grass, paths and walkways, and structures), other participants, of any magnitude, including fatality; and he/she/they waives any and all claims, of any kind or nature that may arise against the City of Seattle as a result of the Participant’s participation in the group classes or other activities or programs; and further does hereby forever absolutely release and hold harmless the City of Seattle, its officials, employees, agents, servants and officers from all claims for damage whatsoever of any kind, now or in the future. 

If the Participant is under 18 years of age, a parent or legal guardian must sign the following waiver:

In consideration of my child being permitted to participate in the activities of Ballard Health Club in any manner, including but not limited to tours or classes, I (individually and on behalf of my family, heirs, successor and assigns) fully and absolutely assume all responsibility for the risk of injury and /or other harm due to participation, weather, conditions, park conditions (including but not limited to the condition of the grass, paths and walkways, and structures), other participants, or any magnitude, including fatality; and I waive any and all claims of any kind or nature that may arise against the City of Seattle as a result of my child’s participation in the group classes or other activities or programs; and further I do hereby forever absolutely release and hold harmless the City of Seattle, its officials, employees, agents, servants and officers from all claims for damage whatsoever of any kind, now or in the future.
